No action simply brings poetry..............................

I know HOW TO WIN? I know how most of my problems can be solved? and i know how the tension that vomits frequently out of me can be cured? BUT!!!!!!!! i am afraid that i dont know how to ACT? Delay and failure to muster up the courage merely to perform trivial duties has now become a regular trait. I analyse myself well but even after a detail conclusion SOMEHOW i again fall into a whirlpool of desires and the web of what others call Satan!!!!!!!!!
The year is about to end and the newyear resolutions will again be the central focus but unfortunately i have used "BUT" now too frequently.............................................
I fear and wonder that these curses i am addicted to are infact the hall mark of my entire nation and most of us are all slaves to comfort and 'noaction'.
For the moment i only ponder:

'Kahan say laoon wo meena o jaam
jo teree rooh-e-ghafil ko baidaar karday
teray seenay mai jazbay-e-talatul karday
tujhay khudee mai fana karday
teray khuwaboon ko baidar karday
teree akal kee roshnee har pal karday
tuj ko TUJHEY karday
Nahin hai ye jam kisi maikhanay main
nahin hai ye asar zamzam kay nalay main
nahin hai ye khiradmandoon kay karkhanay mai
nahin hai nahin hai ye teray aaba kay kashanay mai
mula kay dam dam bharay jamoon mai
too chalachal haq kee raha par
mushkil kee, taklif kee parwa na kar
batil ke teergee ke or zalim kee parwa na kar
jis abar kee tujko hai talash
wo Shabbir kay katra-elahoo mai hai
har kisi mai hai jo baibasi mai hai
har ous mai hai jo talash-e-khudi mai hai
Yahee hai kosar
yahee hai naihray bartar
yahee hai jaam-e-zindagee
jo raha baki to asal hai yahee zindagee
talash hai naam-ezindagee
khudee hai zindagee
musalsal waar hai zindagee
jo na ho jazba-e-himat bakee
to zindagee hai mot, mot hai zindagee

A way in the world

Still the old status: Miseries have now transformed into feverish arrears and the life hangs in the air. Analysing deeply, i am still appreciative of God's intentions. When we feel that so much lies on us, its virtually none and when we feel helpless the troubles are nothing but slaves to our actions.
Weddings are on!!! and by this day i have already attended 9functions with virtually no climax without food. SO SHAMEFUL! but then who! Supreme Court has banned serving food on marriages.........................4 wedding functions lately, had police strutly guarding the food courts. The food was delicious and i had just returned from SOMALIA

The fruit of ANGER.....................

When i am angry i really mean it. Compared to others i go full mad and nothing comes calmly to me. The instinct to distinguish relations simply vanishes and later when the lava cools down, the remains are only regret and pain. But!!! at the moment i am really boiled up for reasons that are both in my power and beyond my control. Ironically, the faculties in my posesstion have failed to counter react and reduce the troubles.
Fear might be the other name of anger but so does it contain an aggression and mobilizing power that can make problems solve. Apart from the fact that it consumes your better portion it also leads to consequences that are both harsh and has long term consequences.
For the moment my anger is still in a cage, roaring and wailing without any harm but soon if it wont be fed, the beast will come out and harm those all around. PERHAPS!!!

After a bunk to Gujranwala, i realize that there are hundreds of more places in the world were the tantalizing tastes of food can be savored. All in all its now a compulsion to be home maximum by 10pm. The brutally blemished record suggest otherwise and rather a poor decree enforcement will allow my survival again.
But...........................................once again i have lagged behind the marathon and though its depressing and painful, i can feel the mellow fire sparks readily posed.
I, Now only need a FRICTION.

Illegal Hearsay

Its almost a trouble now. I am doing free advertisment for blogger.com, from my friends to my teachers and then also to those who will never step in for writing challenge. The day was Friday and PCL was finally there as i stepped in for procedural doses. The herald for juniors was announced and the junior guys really did well (Gals too)!!!! Unpredictability of PU is what makes her loathable and loveable so when everyone makes you feel that its your final year, fees are in the college chest and the courses are half way down the stream, this December never sounds good for the results.
In the deep recesses i believe i will atleast get through! but quicksilver moments happen when they are most unlikely. Then Friday also comes naturally to me so when everyone prepares for the prayer i also equip with unwanted tools. In each case i have to uphold the supreme lodester of 'honor', no matter what happens, i will try maximally not to shatter the esteem and honor of others and obviously i will defend fully when my personal empire is at stake. People never realize that privilege things will remain privilege forever and even a wrong step taken should'nt be regretted, forever.

Think, ponder, observe, decide and ACT

I am feeling Deprived (with Capital 'D'). The half glass theory has lost its charm and now i believe i should thrive for excellence. My limitations are only quasi, self created and can easily be conquered. At the moment i think instead of being a motor-mouth the best thing should be to talligate my own moves. Then i also realize that its foolish not to live without risks, afterall my best moments in life were when i was living on the edge, obviously some of the worse moments also came as a bi product. I think hard but without conclusions, just stray reflections and perspectivity is what finally dawns in my head.
The most cherished verse of Iqbal says so:
Khudi ko kar buland itna keh har taqdeer say pehlay
Khuda banday say khud poochay, bata teree raza kiya hai
(Construct your self esteem to such an extend that before every destiny move, God Himself asks Man, wish whatever you wish for!)*
I think this may be the most tortured verse of Iqbal, but the preceding verse is my favourite and conveys more than this one. This verse was formulated by Iqbal when the Atheism was enlightened moderation and Darwanians were celebrating their school's success.
Khiradmandon say kiya poochoon keh meree ibtada kiya hai
Mai to bus is fiqar mai rehta hoon keh meree inteha kiya hai
(Why should i ask the atheists about my origin 'start', i only ponder as to what my maximal absolute point would be!!!!)*
Hardworkers and men of action have only contributed to this world. Rest has only been an overweight on this planet. I am swinging like a pendulum between the two communities.
*The translation of these Urdu verses are not fully accurate, however it conveys all and as usual law gives me the patent rights and Musharraf has just recently signed the Intellectual Property Rights Ordinance.

Mental gridlock or utter Ignorance?????????

There are times in life when you grope for a purpose. A captain of a ship usually feels unemployed when tides are low, movement is smooth and his ship floats without any trouble. So, then he roams on a deck, almost agitated and passes orders to his subfellows having little utility. Its not that i want a high tide, but something which will make me busy. I want to feel deployed and not employed. While driving back from Rawalpindi on GT Road my brain got pregnant with ideas several times but now i feel its the miscarriage that again has happened.
These days winter is on and though its not chilling in Lahore by Alaska standards its enough to numb my soul. Quite frankly i feel very comfortable when amongst people, as it allows me to speak or rather a new blunt term of "dog mouth" that best describes my habbit. I know that this time of uncertainity will pass soon and then i may miss these moments but in any case on a larger statistical board this part of life will easily be tallied in "Days of ignorance".
Who so rightly said:
"When you have nothing to do its the perfect moment to fall in love...."

Blogspot: Entering free market of bloggers

Even today i feel so proud whenever i end up writing even a small article. This truly gives a feeling of a father when his child is born. But! Now i have went through atleast two dozen blogs and the callibre of creativity, clarity and enrichment has put my CHILDREN almost ashamed. Obviously i have read so many books, including the best of best literature, Nobel laureates work and legal philosophical dramas but Man!!!!!!! some of these bloggers are damn good. From one perspective this make me feel that my country rightly lags behind, the other version suggests that the world is not too appreciative of these worthy people. Then i rethink that does stitching language really counts? and may be some of these guys really are earning lots of fluse. In any case its been days since this blogspot was born but no one has yet to reach my baby. I dont complain any more, i will raise this kid like a good Dad and vows to help it grow. Then i wonder that whether my labour matters or not. After all in any circumstances this blog will remain motherless.
The world will end, men so frequently die and amidst all the rough conditions this blog is pressing the need to "live" and make God proud.

Abolishing Capital Punishment (Healing the Killers pain)

Humans are composition of diverse and enrich instincts. The infinite manifestations of these instincts leads to an overall individual and social expression, evolution takes place by relative will and desire of each society but however happens at a snail’s pace. The existence of law is imperative to any society even if that society is a co-habitant of barbarians in a jungle. The nature of law if fails to match a particular community it attempts to govern will sweat away from its surface. In this contemporary world of globalisation and ripen International law, impact of each legal system on others allows the dependant growth of every legal system. From here an individual surpasses his communal, social, religious, racial and national barriers and attempts to become a “true” human instead. The common values, rights and legal guarantees he shares at large with every human then becomes an “International legal responsibility.” To this endeavour every municipal law not only provides a code of conduct but also certain set of universal objectives and goals to be achieved. Thus modern legal systems allow an inbuilt “legal evolution” process in their constitutions.
Since the supreme function of law is merely to provide set of rights and duties, it is then viable to comprehend as to when the same law provides limitation to the disposal of these obligations. An uncontested right which appears vibrantly in all legal codes pertain to “right to life” of a person. The unending nag for most social scientists and jurists happens to be as to when this “right to life” of a person ceases to exist. To those who label it as an “inalienable right”, capital punishment creates vigorous qualms and anxieties. Whether a death caused by a legal machinery pains us more or the one perpetrated by one person to another? This defines at least one pattern of our present discourse. Interestingly the capital punishment does not confine itself as a consequence of only a homicidal crime or a murder, but also results as a disciplinary action to many named “crimes” of state or sovereign. Arguments forwarded by those in “total abolishment” camp in true sense never outweigh those points, which favours its existence. A third group providing a visible mediation talks about “Abolishing liberal use of Capital Punishment”. It is still interesting to observe that whether this faction actually favours capital punishment or provides another benchmark in the evolving legal system whose ultimate aim is its complete elimination?
The utility of this discourse is nevertheless immense as it amounts to new legal relevancies and provides breathing space to conventional views on “theories of punishment.” The present study instead of focusing entirely on the views of both groups of the debate will elaborate perspectives on the present issue. This will not only allow us to comprehend both views but help us understand the significance of this debate, route it has taken and what seems to be its probable future. Countless theories on this issue haven’t been individually dealt but their views will appear continuously without specific mentioning. The conclusion will only signify my personal inclination on this issue instead of an absolute opinion favouring each side of the subject.

Historical Experience

The history of a man is also the history of capital punishment. The infliction of death penalty has been used as a consequence from “regicide” to “pick pocketing”. It cannot be denied that “death penalty” also has its political motives and its usage historically has been frequent against any form of adversary. In each circumstance its presence was considered inevitable for any criminal code. The answer to “What to do with the criminal or adversary?” was readily provided by capital punishment. Both Hammurabi and Justinian legal manuscripts never engulfed the death penalty; later in the religious Divine volumes existence of capital punishment fuelled its exercise. A positive impact was also however achieved and which related to the limitation of its use. In Europe several monarchs and other “bloody codes” ascertained the capital punishment. Even in the era of “enlightenment”, apart from few jurists capital punishment never became a vibrant riddle to be tackled. Voltaire so vehemently stood for total abolishment of capital punishment but grund-norms only stirred conservatively. Later the effort to eradicate capital punishment shifted the discourse from legal bear pit to literary zone. French Victor Hugo provided rationale for its abolishment. His continuous insistence was that only an experience with “death” would force people to make a sound decision.
In the other parts of the world strongest advocacy for eradicating capital punishment came from people like Leo Tolstoy and later Mohandas K Gandhi. Their approach towards the issue made a considerable boost at a social front. By late 19th Century with “freedom” taking a new meaning capital punishment had disgust impact on several societies. A great leap surprisingly came from South America where Venezuela became the first modern nation state to abolish death penalty for all offences in 1863. The World War I made a great overhauling of the subject and it was seriously considered again. The experience of “human misery” and zeal to strive for a “civilized” world contributed much to the abolishment movement. Interestingly across the Atlantic in United States which also inherited English “bloody code” of 17th century and many states acceded to suspension of capital punishment earlier, reemployed it in 1920s.
The development of International law continued at the other front and finally at the end of World War II certain civilized norms were globally recognized. If not so inherently then impliedly Universal Declaration of Human Rights 1948 further mobilized the efforts to demonise capital punishment. Post World War II also produced famous legal decisions, which shaped the debate. Ironically major came from US Supreme Court. Furman v Georgia (1972) asked for official suspension of death penalty but soon in Greg v Georgia (1976) it was overturned. The capital punishment acquired the premises of human rights and by the end of 20th century most western countries have already done away the task of total abolishment.
In the other parts of developing world and Asia, capital punishment remains a weapon, which so strongly regulates the criminal code. It is rather unfortunate to observe the advocates of capital punishment so tacit and broken in their voice. Though evidently they fear the charge of being “uncivilized”, recent historical events and grave happenings are forcing the westerners to have some appetite for capital punishment.

Development of theoretical discourse and a Retributive exercise

The demand for total abolishment was never chased initially. However a deep urge was there that petty or unmatched crimes were not followed by capital punishment. The list of crimes resulting in capital punishment was long enough to terrify any society. With redefining the purpose of state discourse gave rise to civil liberties, the “death list” was thus screened and short-listed in the mean while. It reached a stage where revolutions, constitutional remodelling, military takeovers, wars and above all economic systems provided both conscious and unconscious development of the cause. In each case taking of life by the state was not considered gruesome but the practice itself was loathed. Human rights activists vehemently disregarded the infliction of “pain” in any form to any citizen and later to any person by the state. It was an established norm for any criminal system that some sort of a physical or mental pain exists for those involved in a crime. On another front when technologies and scientific advancement created new modes of “execution” and “torture”, debate mobilized itself and movements in western countries were all active that the worst of worse criminal is after all a human. An alteration in the mind set was possible where libertarians defined the course of society completely and to be civilized was the ultimate aim at the brink of “space age”.

Perhaps the strongest card for those believing in capital punishment relates to the retribution. Since only a state can exercise retribution for a murder or homicide, to prevent further derogation of law capital punishment itself provides a breathing space to the entire edifice of legal system. An undoubted fact that club of murderers will always exist. Thus to minimize if not absolutely eradicate their existence capital punishment is a fruitful exercise. Deterrence and some sort of bulwark are also ensured by this painful exercise for the society as a whole. For “abolishers” adages like eye for an eye, tooth for a tooth, hand for a hand, life for a life or any sort of such retribution is vague. They believe that a simple retribution is unjust and only a “perfect retribution” if at all should exist. Since perfect retribution is not possible let the practice at all be abolished. An infliction of pain is never balanced even if with all the precautionary measures are followed. Another interesting point in abolishers’ camp states that some crimes are definitely not perfectly compatible. As a murder of more than one person or in case of genocide a criminal will still be put to death only once. Secondly the old adage eye for an eye limits itself in cases of crime such as rape. Indeed “rape for a rape” will not be acceptable to any community. In pursuance of capital punishment as to who should carry out “state retribution” also creates a problem. The question then vividly emerges that “Does a state really carries out an execution?” Certainly Not! State even then allows individuals to carry out the task. Executioners are ultimately allowed to take lives though on the consent of state but unfortunately become a component in a retributive chain in this process.
The contemporary world provides an interesting model of US, where each state regulates its own independent legal machinery. Statistics then emerges that all states where capital punishment has been abolished crime rate is lesser than those states with functioning legal penalty, quite clearly if the object of punishment is deterrence then at least capital punishment fails to ensure it there. Another discourse which may emerge from this pertains to the fact that abolishment is merely a call of developed states and not the developing ones. If the social and legal stature of each society varies then let its punishment tools vary too. Whether such practice is a divergence amongst nations of the world or is it a hindrance in the development of International law as a whole or even for that matter really against UN Charter is certainly unclear?

Effect of total abolishment on societies and on criminal law

Obviously abolishers fail to sketch the consequences of a worldwide pronouncement of total elimination of capital punishment tomorrow. Without the assistance of a crystal ball one can easily say that a planetary havoc will be created. A worldwide crime rate will shoot up. Criminals will take it as a formal “licence to kill”; societies prone to violence will be pushed in fire, libertarians will join hands with murderers voicing their rights, law-enforcing agents will become impotent, some level of retribution will take place by individuals against their adversaries, jails will be stuffed with countless persons with authorities unaware what to do with so many “reformers to be”, executioners will obviously be fired (lest they cannot go on strike) with their only experience fuelling up the crime rate and above all a criminal legal system will lose its charm.
Even if some of these predictions are nonsensical some of them holds truth and most legal systems will experience these problems. A rather blunt justification of capital punishment comes from economic perspective. It is certainly not economically viable to put energy on reformation or deterrence of a hardened criminal. The cheapest way is to dispose him off. The jails have its limited function and cannot be transformed into rehabilitation centres. A criminal to commit a crime is overwhelmed by the instinct and mostly oblivious of all consequences, which follows. A capital punishment if not at all stop him will at least keep the holiness of a law and will brutally follow those ruthlessly transgressors who disregard any existence of a higher code and handle other human lives cheaply. Whether they be placed behind bars till their natural death or immediately killed which ultimately remains their only goal is perhaps for some not a laborious query. It cannot be treated lightly that a total abolishment will make a criminal legal system lose its charm. Though not merely for a sake of charm it should be kept but uninterrupted historical experience of handling a criminal comes from making him experience some sort of physical pain and for ultimate criminals the execution. Another blunt political practice, which might emerge from eradicating capital punishment, will be of extra judicial killings and states in their attempt to impose their writs will extinguish their needs in such a way. The present legal systems are also laborious and lengthy enough that procedural and substantial issues vigorously contributes in a verdict that not many death penalties are announced .The figures of annual death penalties that take place in US are so low that rarely it can be justified as an active form of deterrence. A judicial bench in any developing country will obviously be more liberal in putting death to the recidivists. Secondly jurists in developing economies not placing the overall society on a plight and will be reluctant to approve the total elimination. Then perhaps it also becomes a true fact that the subject of elimination only matters in which environment one stands and the overall economic position of population around a person.

Conclusion

It cannot be denied that even in case of total abolishment right to kill will still vest with certain categories of people in certain environment. The International Humanitarian Law or Law of Wars allows military men to kill the adversary soldiers. An attempt to strive for a “perfect peace” will be impractical. However to obtain a “real peace” vibrant in nature, capital punishment provides a weeding practice to the state. A punishment greater than the crime is not wanted. Torture, other harsh means of execution will be irrelevant even if a death penalty is to stay.
Humans in an attempt to create a just world are forced to adhere to the principle of rule of law. Since primitive the human experience explains that war, battles, killing, murders, genocide and a human inability to remain humans is inevitable. Then whether abolishment or not, humans will continue to die because of humans. The future therefore will be the same except that each event will be better magnified, and will provide us with a better and more sophisticated rationale tool to examine it. Most probably in future the capital punishment will be a weapon denied by all but will be used liberally and sheepishly by all states including those who advocate it. So better not kill this animal but cautiously breed this “endangered specie” perhaps forever.

Sounds of the day

He came back today. Obviously i was so glad to meet Ijaz after almost an year but at the same time i was sorry for him. Although his charm, glow and tantalizing wicked smile was there but his over romantacism to transform this poor state into a western chick sadden me. Noway i am a pessimist but surely he is acting almost fully deviated from reality. Pakistan has to change but not on the English terms but on her own. Imran is also right as most of us make tons of theories but they remain undressed for all the reasons.
I still stick to my so correct oldage adage and personal conclusion. "Changing the environment you live in will ultimately change the breathing environment of others."
Ghalib also rightly said:
"Wafadari, shart astwari asal imaan hai,
maray butkhanay mai to garo kaabay main brahman ko"
(Unconditional and persistent fidelity is true faith. If die in a temple then put brahaman 'holyman' in kaaba)*
At the moment i have list of arrears to address but obviously i will procrastinate them either for couple of hours or for atleast 4days. So long was the day and it never came on my terms and quite clearly i denied my actions. The wedding season almost haunts me. This month i have to attend atleast 7weddings and 20 wedding functions with virtually exhausted account.
Its not a world of misery after all and i believe that all in all stay on this planet is bearable. For a moment i am only pressing the need to talligate our ownselves than to judge others destiny. The rest are only stray reflections.
*The translation though is not entirely accurate but law still gives me the patent rights.

All for economics and economics for all

Economics has so much to contribute to any society that somehow it overwhelms other operating powers of any social order. Sometimes history seems to be a product and struggle of economics than of any other reason. The transformation of economic values from the domain of arts to mathematical and scientific frame has given us a challenge to re-think our opinions about the subject. The economic laws governing relationship amongst people of its society and that of the entire globe seems to have undergone intense overhaul during the last few decades or so. It is interesting to observe that the most vigorous development that has to take place in legal arena constitutes those relating to commercial and business relations of people as compared to penal ones. The wheel of civilization has only been mobilized due to the economic goals in the sight. Even if some activity has been out of the instinctual happenings of a person even then, the financial cause has just perfected it.
As we move into the 21st century world, where nations only have the sophisticated tools of economics and commerciality to survive on, there is a need to establish the institutions, which could uphold the economic legacy of mankind and can draft laws that can control the conversion of human demands into detesting desires. It is impossible for us to exclude ourselves from the global economic paradigm. All the emotions that derail us from forming a rational opinion in fact hinder us from our economic growth. Though even economics has to be regulated within the spheres of law and social justice can only be achieved with the supremacy and rule of law but necessarily a selfish instinct embedded in humans and which transcends at the state level has to remain supreme and which can in a best manner achieve financial and economic gains for us both at micro and a macro level. It is important to understand the fact that all dogmas even religious ones aim to guard the relationship amongst men and elaborates the presence of Deity beyond our imagination so as to organize our affairs with others and which might get damage in our economically viable approaches. The strength of monetary, fiscal and other gains is so great that surely at a macro level it defies all the human moral and social norms. Only an equal or stronger economic might, resist the pressure of such a state and thus the two societies co-exist. A common end of economically beneficial value boosts their relations and thus the focal point of every macro relation remains trade, commerce, business and fiscal ones. Though other interests have to be catered but they then have secondary recognition.
The field of economics has broken the shackles of military dependency and today it is the military strength completely dependent on the economic resources of a nation. The world geography has undergone a great renovation in the past century. Some dictums of history remains true, the greatest of all relates to the survival of fittest…. Fittest these days refer to economic fitness and no more the armed one. Gone the days of weapons, which could dominate other resources. And so we have the time when economic powers slowly creeps in other societies with their products and services sparking all around under the guidance of law. Economic imperialism thus prevails; they dominate everyone’s resources not in an unlawful manner but just because of our incapacity to do so. Thus as the world stretch its arms in the new millennium, there is a need to find our place in the world of economics and embrace the realities which are bestowed upon us by the acts of others. Emotional confrontation has little significance, but economic valour crush nations, formulates the global destiny, ensures internal justice and unleashes every other potential of a society.
Materialism has to govern every relation in an environment with economics as a dictating force, but even so such happens where other isms prevail. The Machiavellian world has furnished strong rules as precedents and history has affirmed them entirely. The selfish image of humans at least could be catered in a constructive manner, let our personal economic activity contributes effectively for our national exchequer. With so many forces working all around it is important we realize that the most dominating force enables us to transgress the laws we ourselves have created.
Though the basic definition by Adam Smith has been changed but rightly so its effectiveness has stood there when he said, “Economics is a science of wealth…” Even if not, it can be rightly said today that, “Economics is an art of creating wealth and the countries that could best do so ultimately carries the beacon of humanity.”

Terrorizing the terrorists by ‘NO’ Law

The dilemma for most states to be in a global war against terrorism led by US has legal, moral, integral and political aspects. The greatest challenge for any state, more if it is a Muslim country comes from physically participating in it at the cost of their established legal codes. A full fledge participation in war may be avoided boldly but evasion of pursuit against “Terrorists” may place a government in an Al-Qaeda camp. The blunt political discourse emerged after 9/11 could not be managed by making chess moves otherwise possible. It was viable for every state to make a decision not on the grounds of principles but purely on the basis of ‘cash in hand’. “With US or against US” left most countries without option and no other manoeuvre could be entertained. Although a decision for a far flung states in Africa, Europe or in the heart of Atlantic was easy not so was possible for countries so proud of their geo-strategic positions.
Pakistan allied global war against terrorism. Many utterly against, few in favour, others dismayed over the deal and most were ready as ever to embrace any decision, which flows from the corridors of Islamabad. Though the legality of decision was addressed poorly and only the political analytical tools measured the participation, it was not so the case when Pakistani nationals were packed to Guantanomobay prison. Pakistan is ill reputed over its adherence to the constitution. So is true that society as a whole also feels no sympathy for rule of law. When at least a significant cry was raised over the government’s decision to hand local nationals to US, we were once again reminded of law. Then emerges the series of queries, were all these people actually extradited? Which crime they have committed? And most important question of all, does the war against terrorism requires any law to operate within? Quite evidently volumes of both private and public international law were explored for a possible answer.
Precedent of Aimal Kansi was exploited in courts of politics. Contractual exile of ex-prime minister Nawaz Sharif was also questioned once again. The blunt face of time has unfortunately placed us at a position where super powers remain oblivious of law to achieve their ends. Miscarriage of justice has now too frequently marred our face. A blunt international decision from the district judge in UK in 2003 says at least of western legal standards. A Chechen rebel Akhmad Zakayev was refused to be hand over to Russian authorities when an application to extradite him was forwarded by Russian government to UK. The District Judge Timothy Workman highlighting evidence of other leading Chechens who have died in Russian Custody.
In an attempt to provide a visible legal mediation at home between the government who so favours the fleeing of terrorists from Pakistan to ‘improve’ its International image and those who so vehemently asks for law to be upheld, much needs to be done. Interestingly there seems to exist no law which allows a government lest a President or any other authority in Pakistan by which they can deprive its citizen of the nationality. Such list of “disowned nationals” can at least provide a litmus test and a mint of legality in our acts in this war against terrorism. Though such legal operations have been done by other states in the world lead comes from KSA. Saudi Kingdom disowns Bin Laden and other most wanted cards. Certain other states in the Middle East have also been performing their disregard for those who are internationally wanted or are involved in crimes against humanity. It is largely believe as principles of Private international law that once “jurisdiction” of a court of law is determined along with ‘recognition’ of an accused is ensured and law is supplemented a trial of a foreigner criminal can be initiated. General Pinochet of Chile was another example and UK court’s decision not to extradite him to Spain where he was actually wanted for crimes against Spanish people also stand as a landmark decision. Endangering the lives of our nationals merely forsake of global war against terrorism which still stands nude and without a legal cloak is unintelligent. Clarity of law may be there, but once again adhering to our principles once again poses a challenge. All those handed over to US by Pakistan, who are of foreign nationals may be an issue of less importance but carries an invaluable detail. To get rid of criminals may be important but ultimately the international power centres must realize that the global laws to address international terrorism needs to be developed drastically, only then it will allow states like Pakistan to “transform” them domestically. In the meanwhile, it is mandatory for Pakistan to bring its decision and ultimate consequences in the fight against terrorism in a framework of law. The municipal law now requires a vigorous overhauling in the wake of our decision. Whether ‘right’ or ‘wrong’ the decision now has started to show its muscles and a failure to respond to it will further suffocate our endangered specie. THE RULE OF LAW

THE RAW WISDOM

The continuous waves of fright splashed my face.
The past, the present, the future all assembled together
Snatching their rights all tore my soul
Fear and trouble, uncertainty and anticipation locked in time.
The gloomy groovy past
The wrestling brain and heart
Nature portrayed a confused being
The tethered body and soul withering away
All would end but even then suffer the time
The world could deliver everything
Yet a merciless man craving for his salvation
The diverse creation, evolution, destruction,
Nepotism, corruption, pessimism, optimism all erupts together
The good veiled behind the evil but temptation rests in the eyes
Every step having two values
But for each entity weather treating differently
My hope splits apart for the faithful are dictators
God showing presence everywhere
So the freedom never my destiny
Unleash the new worlds
But troubles would never end
Contention do exists but a trailer stays for brief
Pretending all the well that could happen yet my face breaks
All the desires that could erupt
All the powers that could follow them merely candles in the wind
My charge box evokes momentarily
At least calm in the sea for a while
Daring to acquire the Godly powers
But the selfish God never shares anything
Giving the power to be a disbeliever
But making an impotent to come out of it
The bonds, the relation that could flourish all the reason to live
The cruel world mars it, smears it, tarnish it
Only a man could harm a man
Merely a man justice a man
The confusion, the helter-skelter
So all the possible wrongs against all the possible rights in this just world
The destination is too far but the journey too short
Let’s build a machine that could kill time or indeed a Man

Better late than never

They say that atleast i lag behind in embracing the rapid technological growth. A man of masses will obviously be proud to accept the charges. For a moment i thought blog will be another reason to stay online and then i think it will be another activity i will lament in future. Pen scribble still is my forever passion and in the world of "tabbing" buttons i vow to keep my old romance alive...........
Welcome to all of you and i am pressing the need atleast for a moment that
"BETTER BE LATE THAN NEVER."
