VICTIMS of VICTIMS (Curse of History)

I am always blamed of writing 'emotions' and 'crowd winning' reasons rather than rational one. Undoubtedly this comes from my sector of liberatarian friends. The other rightist are not ready to accept me in their camp.
The recent events have almost forced me to jot down my share in the ongoing war. I see the conflict in following ways.
1) Legally
2) Historically
3) Religiously
4) Politically
The legal perspective is clear: Hizbullah initially violated the International Law by capturing the Israeli soldiers and killing around 5 Israelis. However this only triggered the 'armed conflict' which was containable but later so ferociously the Israeli army violated the International Humanitarian Law and the established norms of all 4 Geneva Conventions. The indiscriminate bombing of civilians and non-military infrastructure was an utter madness and some barbaric acts (recently of Qana) do come under the 'WAR CRIMES'. Hizbullah also has a brief share of violating the International Humanitarian Law by bombing non military targets in Haifa.
Historically i am inclined to take the so called 'wrong' side. I can't forget the incapacity of the entire Arab and Muslim world to take on their enemy. The so cheap way of 'selling lands' to Jews and playing Poker in Aksa, with pimps strutly moving outside is a true muslim history. I also believe as in Quran that 'though we will not like war but it is bound to happen' and some decisions are only possible through war. The unfinished war inflicts further misery. Personally i really wished at least one war to have reached a final CONCLUSION. The battle of Siffin was avoided in the final hours by placing Quran on spears by Muawiya. Unfortunately the Muslim legacy of Siffin will continue, historically speaking perhaps forever.
Religiously, i simply cant bear the sight and plight of miseries of my Muslim brethren. Although even as a human its unbearable but being a muslim, almost unconsciously i feel pain after such events. No matter how much i try to ignore it.
Politically, it is an established tenet that the western world wants no threat to Israel by any state in the Middle East. In exchange they want to guard all their economic interests, and Imperial control.
Lastly i personally believe that Muslims should now accept the right of Israel to exist. Any insane military adventure (whether from Iranian boasts or other Umma interests) is insane. Secondly the WEST MUST understand that their is a HUGE HUGE difference between the REAL terrorist muslim organizations (like AlQaeeda, and other Lashkar, sipahs etc with global visions and more importantly less sympathy in the Muslim world) and Hamas or Hizbullah which are not terrorist but has a legal patronage under the International Law. They are not only democratic but also has a right to carry weapons against Israel.
Unfortunately the principles of Natural Law holds for all time, no community or nation can outstand its cruel test. Ignorance, humiliation, suffering, bondage, occupation and pains can only end once they are accepted. To be victorious ultimately, acceptance of defeat is must. Muslims must understand that their present visions of all kinds are not taking them anywhere.
Lets dare to accept the Treaty of Versailles, or even worse and come out as better humans (understandably better Muslims) after a thorough self probe.....................

I feel this everyday NOW.......Quite FUNNY

Time is passing quickly. I have to act fast, resist all my temptations and move without any interruption. Things will not change unless i bring it about in my ownself. The world cares none and in this brief odd life, i have to put up the best show.
The consequences of my failure are beyond imaginable and with each passing moment i can breath in its painful taste. Yes, I have found my way, long and full of short run troubles but beyond its serene and comfortable. The lusts of the world wants to take me away, and though i will succumb at certain points, but ultimately my unending desire to achieve the LAKSH will prevail. I will fight and this is a COMBAT season. Its no time to waste and sleep must wait.

I thank God, for not fulfilling our every desire. I wonder if this could happen, what would happen? As a law student and as a poor social observer, i believed that the gap between the theoretical and practical world is a cause of real mess in this whole world. To some degree, this is absolutely true. But both these domains are completely apart and yet linked. We are free in thinking all the unthinkables but limited when it comes to actual business.
What if the wishes of following would come true:
1) My wish to achieve everything without the present set of life style and poorest struggle levels.
2) A Mullah wish to turn this country into their Islamic State.
3) A shiite wish to turn this state into an Iran type State.
4) A sunnite wish to turn this state into a Saudi Prototype State.
5) A human right activists wish to turn this state into a Secular State.
6) Every Pakistani's wish to make things go his favor entirely without difficulty.
7) Our prayers in every pray, to have ONLY joys in life.

And zillion other wishes of zillion people.
I came to a bright conclusion that if all our wishes come true then no more we will be beautiful humans, we will become God and we should better mind OUR own BUSINESS. Adversary make our lives beautiful and though we will continue to be imperfect, its time around to stay in this world for SOME TIME and go back home. A wish chaser will be a loser even if he gets it.

Verily, Man is in crises.............

I like writing but blogging came as an opportunity with crises. Since the time i started to blog, my focus of writing is not to satisfy myself but to what others may like or want to read. Last 40 odd days will consume me to think about this issue too. If it is a forum for advertisment and the GoogleAdsense certainly adds to it, then no way i am successful in earning a penny from this. Secondly, if i want to promote my dogmas to others, i am so clear now that before you preach you should be preached. Thirdly, one reason of my rare posts owes to government decision not to pave the way of its ready access in Pakistan. Lastly, even here i feel like competing with fellow bloggers and in this process will kill my already wounded potentials.

Not self contradicting myself but the posts will continue to appear on this blog because it is certainly an active forum where people can learn from other's experiences and few others like me can narrate their inside.

*I am tired. For the moment its enough of this worldly experience.
In the words of Faiz:

"Apnay abao ajdad kee meeras hai, keh phir bhe jeay jatay hain
Kiya ye kisi muflis kee kaba hai jis mai har gharee zulm kay paiwand lagay jatay hain"

(This life is a bequeathed legacy, and we keep on suffering. Isnt' this life a poor man's shawl, where patches of pain are wooven every moment.)

From life to jokes

I think the funny part of life really comes from enjoying it. Ultimately everyone realizes that life is SERIOUS and if it goes even without a meager effort to help others, its of little worth.
The 'fun', i think is not relative and though its degree or boiling point may vary but the basic formula is same for all.
Fun and make fun is clearly a difficult art and not many will be able to distinguish between the two. If you enjoy the fun it is a true fun but to enjoy the "make fun" will come at the cost of "hurt". Although the hurt level of many will be unreasonable but i guess lets co-exist with them. Following instances will provide interest.

1) A cousin, Major in Army is too swagger but yet a funny man. On the dooms day of 8th October 2005 he was in Kakool (Abbotabad, 'one of epic centre) when the earthquake struck. He was at the barber shop, tied in a sheet with everyone around saluting him. The barber smeared half of his face with the shaving cream and then...................The earth quake, and everyone ran out of the shop but he in that funny position was dismayed. His subordinates then yelled, 'Sahab afsari chado tay naso' (Sir, forget your position and just run). He also ran frantically and stayed out in the open with still a white apron and half face with cream on. The entire Academy saw Major Sahab in pity and the rest are details. The best thing however is that he narrates the event to everyone. He is still a swagger and a Major with a funny past.

2) My very close friend for the last 17years got the name "PHAT PHAT" (from derivation of Rickshaw phat phatty, further derived from his family name RISHI) in class 3. He was toooooo famous all over and seems to be normal about it until one day last year. He got a job, prestigious and formal. Then the poor chap encountered the old enemy in an office meeting after long. Unfortunately the other guy forgot his name and called him sheepishly "YAAR PHAT PHAT WHAT IS YOUR REAL NAME?" Rishi is still a cool chap and never stop mentioning this moment to others.

3) I will skip all the parts and come to the core. "PANDHS" or Bards and the first state that should come to everyone's mind must be PAKISTAN (specifically central Punjab). They joke from all range. Personal, critical, very personal, abusive, female related, animal related, state related, society related, religion related and every related. They will make you laugh till you will fall. Interestingly they do it all without any formal practice, just extempore. One of them said at the first night of his wedding to his wife, after he sees her for the first time. "Oye kina hatorie warga nak hai tera" ( How hammer like your nose is?) The instant reply from the wife "Hotoree nal apnay kil thok lay" (Hammer your nails with this then?) I wonder if non-Punjabiites will feel by the way all these jokes happen.

The point i am trying to make is that the joke no matter of what form is interesting. A painful fact is that "THE MOST INTERESTING JOKES ARE ALL RELATED TO SEX". Now what do do? I guess more than defining the boundaries of the joke, the most important thing to learn is "When to joke, and when not to JOKE", because life is indeed serious and those who fail to learn this never become a joke but tragedy.

JAGO

Aooch!!!!!!!!!!! I am so embarrassed.

Ali Shahji jag jao (Wake up) or else...................

I only say this:

"Humain gehray gehray panioon mai lay jao
Humain oonchay oonchay parbatoon mai bhaij do
Humain har aag mai ab dhakail do
Ye tamasha ab ho ga zaroor
kehair phootay ga dur dur
or ab janchay jain ga
Oun mai kitna dam tha
jo har baat par kham tha
jo ghulam na thay
par afsos tootay to aisay
keh phir choora choora ho gaye"
(Ali ~`)
English Translation:
Take us in the deep abyss waters,
Send us to the high mountains
Push us now in every inferno
The show will indeed take place
Doom will now happen in far flung
And then they will be measured
How much courage they had?
That will ooze always.
Those who were in no bondage
But Alas! when they all perished
Even their remains scattered. (Ali)

Birthday.........AND THIS TOO SHALL PASSSSSSSSSSSSSSSSSSSSSSs

26th April 2006, it was my 23rd Birthday. I feel no change except the fact that the resilience rush has declined and ebbs of all sorts mark my face. Nevertheless the way i was greeted by my family and friends at 12 last night was awesome. A special cake from loving sister and these days its her 'income' is what i rely on, when Dad's riches refuse to drain into my pocket. LONG LIVE MADIHA.
As far friends, Ahsan, Ahsan, Hassan, Nosherwan, Usman and Ehsaan came at 12 with a 'qula' (a long desi hat) and then smeared cake on my face. Later, we were off to have Icecream. Then came the real part. They paid Eunuch for a dance and 'kiss' to a birthday boy. Although she allured them sheepishly but we were few good men . After Icecream at around 1am we sat on the Jail Road near a Dhaba ( a real small untidy khoka) to have tea. Then we gave lari adda (Transport hub) and Shahi Qila (Lahore Fort) a GOOD LOOK. Real good look and finally by 230am we were at DATA SAHAB (Holiest Shrine) to pay him homage and for mystic upheaval. I came home at 3am and my mother then gave me a good harsh physical torture. That was one gift i received after so long.

Thanks to everyone who wished me on my day. I am so happy to have them as my very own. Greetings came from USA, England, Holland, HongKong, Mumbai, Delhi, Karachi, Faisalabad, Sargodha, Rawalpindi and obviously from every quarter of Lahore. I expected from number of other sources but to 'forget is a human', i guess! I GUESS ONLY...........

Anyways another year is over and this too SHALL PASS......................................

All templates were absurd and I was out for a change. So just thought of this 's---light' dark image and obviously no criticism about this will be TOLERATED.

The Country i dream of!!

Here an article, although in Urdu depicts Pakistan free of violence, sectarianism and suicide bombs, in the past. I guess i really yearn those days i have never seen myself.
Only now i have realized that
"WHEN I KILL TIME, ITS ACTUALLY THE OPPOSITE."

WHY the hell they dont accept my points without someone Dead in history affirming them? Ironically, they call it a RESEARCH. I wrote, if not prolifically then REASONABLY, but no dead would be my WITNESS.

At the other front, blast in Karachi has also wounded my heart with at least 55 deaths and hundred injured. Its an uneasy stress mounting in my chest. I gasp for breathe but ultimately inhales mourn, laments, cries, qualms of this society and my further recklessness. I am a recidivist and criminally a QUIXOTIC. The gap between my theoretical and practical world stretches up and rounds of 'ignorant nauseas' dawn on me, each second. My delays are ready to terminate me.

Guns and Roses

Q. Why the sharks dont bite lawyers?

A. Certainly, because of PROFESSIONAL COURTESY.

The lawyers are notoriously known worldwide and i have no problems with it. The MEN IN BLACK put their curse on society, make others moan and mourn. Morality knows no lawyer and these freelancers will still threaten the world by the mere sight of their uniform. A lawyer friend joked that if all the lawyers in the country will unite on the Mall they will overthrough every regime, whether militiary or political. To attain LLB degree is the easiest job in the country and even "Munna" bhai's will have no problem in taking the exams. I hope the producers will find it more convinient and invest worthy to make a film, none other than MUNNA BHAI LLB. Interestingly, the movie was made in Pakistan which was a flop, not because of its script, actors or direction but because of 'no' lawyers in it.

Even at the literary front Akbar-Abadi famously said about lawyers:

"Paida hua wakil to Iblees nay kaha,
Allah nay mujhay sahibj-i-olaad kar diya"

(When a lawyer was born, then Satan (Iblees) said that God has finally bestowed a child to me....)

Despite the fact that it is the most loathed profession on this planet and no wonder so many people deterred me to enter the legal field, I SO STRONGLY believe that THE BEST and THE WORSE of any SOCIETY are LAWYERS. No one but the LAWYERS. They truly believe that there is no room in this world for MEDIOCRES. I like this profession for millions of reason and one basic reason is enough that God HimSelf has declared that one of HIS cherished Name is WAKIL (A LAWYER).

Faiz Ahmad Faiz said:

"Jis dhaj say koi maktal say nikla wo shaan salaamat rehtee hai,
Ye jaan to anee janee hai, is jaan kee koi baat nahin."

(The way a person comes out of the battlefield, arena, that glory remains for all times.
As far the life, this life comes and goes, no worries about it.)

Lawyers at their best follows this dictum and no other profession.
SALUTE TO ALL THOSE WHO STRIVES TO UPHOLD THE LAW.

Indecisiveness

Like always the first step is so difficult, As soon as the moment arrives, somehow the struggle to pull myself up becomes difficult. Not so strangely, it has happened now for so many times. The problem is that despite the fact that this is indeed the right way. All troubles will ultimately be solved once this step shall be taken. I feel like going for a bungee jump, to stand on this precipice with defeat at your back which will soon overwhelm you but the trouble is to muster up the courage and dare to embrace the freefall. If the death is inevitable then does it really matter how it comes? It shall dawn.....
Knowledge without application is worse than utter ignorance. All the options are exhausted and this is the twilight of all the entertainment. Now for the real world, real action is required. Unfortunately for me not religion, not any other dogma, no relation and no power could influence so strongly that finally I could be stirred. The romance and compulsions are not natural and by the end of this day I doubt once again if I would be in the same shape or worse as if I am now?Let’s see. Tomorrow is so close, yet too far. The verge of decision making and the incessant desires of short term comfort lure me away in its deep arms. Those arms are of ignorance but admittedly provide a balm.
A poor human tendency to ignore the long run and the perfect example comes from my end.I hope this day would be better than yesterday and still a benchmark of my flight for a better tomorrow.

The actual JOB

It is the precise time to get back to studies. Here by ' studies' i mean following:

1) Civil Procedure Code 1908
2) Criminal Procedure Code 1898
3) Law of Evidence, Qanun-e-Shahadat Ordinance 1984
4) Constitutional Law III
5) Minor Acts
6) Conveyancing and Pleading
7) Income Tax and Labour Laws

For the past three years my version of studies was everything but academics. The reading habit i am so proud of now needs a right direction. Hope things go right, unfortunately the SAARC Moot competition in Karachi next month also seems to be a painful impediment.

When everyone looks WEST, it is the best time to explore EAST.

The backdoor diplomacy is over and with loads of arrears to encounter back at home, it is not a good time to reminisce the golden days of life. India was partially new, TajMahal only a White House but somehow the new bonds formed over there have a strong aura which makes the body fidget and incessant desire to meet them again pops up. Unfortunately THIS TOO SHALL PASS but for the moment it is certain that MY PASSAGE TO INDIA made me stay with my new friends FOREVER. Almost Forever..................

JURISDICTION FRUSTRATION

The Latin term “Juris-dictio” or ‘law saying’ will later become the fundamental term of every legal system and for the bulk of laws developed by all nations. Ordinarily it will reflect in it the space and a stretch between which a certain law would operate. In the procedural laws the jurisdiction issues will arise frequently and even the most wary legislatures will coy from defining absolutely the ‘jurisdiction’ because of the magnanimity of the term. It is however clear that in territorial area of laws, a general jurisdiction will clearly define its boundaries and parameters. The present paper will attempt to deal with ‘Jurisdiction’ as unfolded in the Code of Civil Procedure 1908.
Since the Civil Procedural laws are to transform so many substantive laws in operation which may fall in its domain, the language of the code is must to be constructed to allow a playing surface for all of them. In at least one perspective every provision of Civil Procedure contains expressly or impliedly, directly or indirectly, and actively or passively its relation with Jurisdiction. It is only possible to identify certain provisions which flavors it well and contains therein the profound and stark features of jurisdiction.

Code of Civil Procedure 1908 talks JURISDICTION

In determining the parameters of ‘Jurisdiction’ in Code of Civil Procedure Section 9 holds a crown position. The section in fact contains heaps of valuable legal perspectives. It allows the Courts to embrace every kind of civil suit except for which the code itself or other concerned laws bar it. This section generates and provide strong strength to the courts, only through the channels which other body of laws allow to flood it. The only check on jurisdiction expressly stated is to the other sister provisions of the same code, the later part of section in its attempt to define jurisdiction announces the other laws and their maybe compatibility with it. In each case this section open heartedly allows other laws to succumb to it. Its legislative explanation further elaborates the scope of jurisdiction of courts to try the civil suits. Since the section is based on the age old principle of ‘Ubi jus ibi remediem (wherever there is a right, there is a remedy) the moment a civil right is to be asserted the jurisdiction of all courts capable of trying it will be invoked. It is however to be kept in mind that if the ‘jurisdiction’ talks about its stretch-ness it never fails to submit to the limits.
In order to invoke a jurisdiction certain requisites are to be fulfilled before actually a current could be sparked in it. Jurisdiction consist of taking cognizance of a case by court, establishing certain points, taking jurally observations and then ascertaining/ establishing the points as understood by that legal seat. It has been held that there lies a distinction between ‘want of jurisdiction’, ‘excess of jurisdiction’ and ‘wrong exercise of jurisdiction’. The Civil Code Procedure also subscribe to the fact that the civil courts have the authority to determine their own personal jurisdiction and when it may be so challenged the court will go through the tests (which the procedural rules itself provide) and in case of failure will not exercise it. The plaint to entertain that suit will thus be returned. Now on the other extreme if the jurisdiction of the court remains undisturbed and the parties to a suit remain contently oblivious of the jurisdiction (obviously not every suit will be contested on these grounds) and the court gives the finding on the suit, it can only be objected on the grounds of appeal, review and revision etc but not on jurisdiction.
In PLD 1964, SC 1997 it has been held that every irregularity in the exercise of jurisdiction shall not result in the reversal or variation of decree by the appellate court. And only the irregularity of serious nature or that which spoils the merit of the case or the serious irregular exercise of jurisdiction may meet veer, but not pointing at an early stage may result in a waiver of right to object at the later stage.
The litmus test to establish a jurisdiction can be several and the major comes from the clarity of the law to which it expressly confers power to the court dealing with the suit. Often in the preliminary inquiry such issues are brought forward. The Section 16 so exhaustive in nature talks as to the territorial jurisdiction of the court and limits it to the immoveable property as is situating in the local limits of the courts. It has been held in 1985 SCMR 604, that civil court has territorial jurisdiction over the entire district and the District Judge cannot restrict such local limits. The other parameters so exclusive to jurisdiction involves Pecuniary jurisdiction on the basis of which competency of a court and its authority is judged. Its purpose is to bring clarity in the subject matter of the trial and this may be usually judged before or at the beginning of a trial.
Another perspective of Section 9 also reveals the jurisdiction of courts to exercise its authority to every individual. The personal jurisdiction thus comes best to define it. Since the law clearly expresses itself to ‘suit of civil nature’ it further emphasis the object of the code only to ascertain or enforce a civil right through a civil proceeding. The PLD 1949 Lahore, 301 held that the court makes no difference between common law rights and the statutory rights. Another interesting perspective reveals that it’s only the subject matter of the suit which determines the nature of the suit and not the status of the parties that comes in defining it. Though this makes us enter the debate of Civil law vs. Criminal law but in its outermost capacity the establishing of rights against one individual to another invokes the civil law, thus the suits filed as a matter of right for the assertion of civil right come directly in its fold.
Apart from that there are however so many grounds on the basis of which suits can be barred and they may all fall under a ‘jurisdictional objection’. The jurisdictional objections seem to be so vast that almost every kind of bar put on the suit in fact amounts to fall in it. Thus the issues of concern for the court are only the jurisdictional objections and not any other relation.
The enormity of the term and its capacity to be used especially in the civil suits seek deep, thorough and clear description rather than its definition or interpretation. The exhaustive journey of procedural codes outshines its masters and the temptation to grope it further remains insatiable. The contemporary advances in legal system and society demands quick disposal of suits and if most of them become prey to jurisdiction in its strong web, the odds are that superfluous jurisdiction frustration will continue………....I really mean it has to continue…….The temptation and frustration like this present so chaotic discourse.

FAR ALONE DISCOVERS LOVE

The heart of a WOMAN who THINKS, in isolation and a distant fear.

Defiance is now for long so let the future be the only judge of her moves. Here she explains love, true love, pure love, spiritual love and nothing but the LOVE for all those who understands.
(This post is for all those visitors of this blog who passes by it frequently without posting comments.)
*The permission of the author was taken before its below publication.

Humanity is the experience of a multitude of throbbing realities intertwined in a matrix that is imbued with beauty, knowledge, love and even emptiness, which is the result of the absence of these. Despite various vices that are rampant in the experience of ‘humanity’ as understood today, in the realm of the spiritual, human souls are bound by the Covenant of ‘Alast’ to the Absolute, the Infinite, the Divine Creator of humanity and all that it encompasses. Prior to human existence, this Covenant imbued within humans the qualities of love and knowledge, and of these, this review will examine ‘l’ove (which I use to mean love of worldly things, base desire, yearning) in order to gain an iota of an understanding of Divine ‘L’ove.
Because of the innate need of the human soul to connect with the Divine, there is within every human a craving, a deep desire to perhaps return to the state of ecstasy that the soul experienced prior to its existence on earth. With the seed of Love implanted within it, the human soul has ventured into the modern era, where not only has the seed failed to germinate in countless hearts, but has been hidden in the folds of ephemeral longings and desires that play with the spiritual heart, so that it is blinded by consuming love.

When speaking of the Divine, it is vital to understand that there is no comparison of any Divine quality in this world. However, there are impressions, indications, ‘aayat’ or signs, as mentioned in the Holy Book, of the existence, and hence the affirmation, of the Divine. In the extract from ‘Love for Allah’ by Shaykh Zulfiqar, love is described as ‘metaphorical love’ and Love is described as ‘True Love’. The point to note in the usage of this terminology is that a metaphor is employed when there exists a relationship between the symbol used and the signified meaning. Hence, love is metaphorical because it is somehow connected to the Love of the Divine that is inherent in the human soul. In my understanding, where Love fails to grow, or where it is undernourished in the soul, love fills in the vacuum and makes the soul ill with its intoxication. Hence, the level of Love in the soul is inversely proportional to the level of love. Where True Love is lacking, there is love of worldly creations, however, where love is lacking, there may either be Love or there may be a void that needs to be filled.

The most striking feature of metaphorical love is that it is full of deceit. In the pursuit of desire, the self becomes so engrossed in the attainment of physical love that thoughts, actions and incentives all center around the obsessive thought of the beloved. There is in love the appearance of loyalty which is only loyalty to short-lived lust. There is yearning, which if satiated through physical contact creates more yearning. Therefore, the immediate satiation of physical desire is not fulfilling, rather it is a lethal
[1] dose of temporary pleasure. An inescapable need to fill the well of desire within will surround the lover so that he/she does not realize that the well is accumulating with toxin so that it slowly poisons the soul, leaving no chance for the growth of the seed of True Love.
The lover joys to dwell
in love with Love.
(Yahya bin Muadh)
It appears as if worldly obsession seems to be similar to the obsession with God that is described in the poetry of the Sufis, in the manner of being all-consuming. However, it is vital to comprehend that the Sufis have experienced a germination of the seed of Love in their souls so that they are in a higher plane of existence where True Love not only satiates them but fills them so that they are at peace and in submission to the True Beloved. There is no destruction of the soul here, rather there is growth and harmony between it and the body which will act in accordance to the True Love.

Another feature of metaphorical love is its characteristic of distance. If nearness to the beloved cannot be achieved, then the lover will continue to burn in his/her destructive desire until he/she loses his/her faculties of rationality. This can potentially transform into the feeling of despair which can aggravate the individual who has already experienced a spiritual demise. This is not true of True Love, which does not allow for despair, but which, instead improves rationality so that it goes hand in hand with the senses and makes them yield to the Love so that they are immersed in a state of continual bliss.

Although the author of ‘Love for Allah’ could have drawn a comparison between yearning for worldly creation and the yearning for God, it is evident from his explanation of the principle of ‘spiritual death’ that the spirit of one enamored with love is ill and cannot fathom any form of yearning except for the worldly creation. Perhaps the best form of yearning for love is that which emanates from the germination of the seed of Love in the ‘fitra’. If one is yearning for someone or something that they hope will bring them closer to God, their spiritual heart may be in the process of awakening, or in the process of learning to fathom the depth of Love so that they can eventually experience spiritual satiety.

Base love is most disobedient to wisdom and sense. True Love is the most pacifying and serene of states. Yet, I imagine a love of creation that is for the sake of the Divine, and that branches out of the seed within the soul. It originates quietly, splitting the soul so that it is aware of Truths beyond those experienced by the body. It spreads like fire through the being and yet, remains like imprints of silent whispers in the mind. It brings about love for creation so that all that is vile in the created becomes beautiful to the inner eye. Such a love emanates from True Love and it is through the realization of this Love that there is an awakening of the heart, soul and consequently the self.

In the state of True Love, there are no concerns of the lover as he/she is in a completeness that entails no worries. This state is unfathomable in my experience, however, God in His infinite Mercy has created avenues upon which to tread to obtain a closeness to Him.

The human soul is the seat of Love provided by the Divine, and the human covers this Love with superficial triviality. How ignorant are we to cover what shines with dust, and what pacifies with what exacerbates! In the passage through life which is full of thorns, we are equipped with an armor that will protect us within ourselves, but we persist in shedding it off to be in our feeble worldly attire.

[1] Illicit love leads to a spiritual death because there is no room in the spiritual heart for God if the heart is full of the thoughts of the ‘worldly’ beloved

INDIA EMERGES AGAIN

The prospects of “Bharat Yatra” are emerging once again, but this time to the capital New Delhi. I would like to visit Delhi for several reasons.
1) Since so many rulers have invaded it several times in history, my share is still vacant. The area between Kashmiri Gate and Chandni Chowk (Old Delhi) is centre of attraction.
2) It carries the flavour of two great civilizations because of its centrality i.e. The Indus Valley (Pakistan) and the Ganges Valley (India).
3) Once again I would like to be a peace pigeon.
4) This time, most of my friends have been selected too, contrary to last year’s trip to Mumbai where though I had time of life, its horrors are extant because of my sublime loneliness. (Not to forget the night stay on Karachi airport, and lost wallet episode in Mumbai)
5) It’s the last year at Pakistan College of Law and technically that too of my academia in my homeland (I suppose).
6) I would like to surprise my old friends in Mumbai.
7) One of my favourite authors Khushwant Singh has so profoundly written about the lusty, charming and libido climate of Delhi, in his novel called DELHI.
8) The journey will be across Wagha on ‘Dosti-bus’ and thankfully not through the haggard aerial route.
9) It carries vital academic significance for my portfolio.
And last but not the least at all.

10) I WANT TO PAY HOMAGE DIRECTLY TO MY CHACHA GHALIB.

The visit is to take place somewhere in mid-March and though the complex procedural requisites haven’t been fulfilled yet, I am looking forward to the trip. In each case Delhi is on cards and despite all the odds against and my CHACHA’S favourite adage:

Dili abhi door ast
(Delhi is still far away…)

Delhi HERE I COME. I mean here I come (INSHALLAH).

THE SELFISH god RESIDES IN ALL. EXPLOIT IT THE MOST, FOLLOW IT CLOSELY AND IF POSSIBLE NURTURE IT WELL. IF WE ARE SELFISH, MOST OF OUR PROBLEMS ARE SOLVED BUT PLEASE DONT TRY THIS AT HOME. I LIKE THIS BELIEF BUT THE TROUBLE IS THAT THE MOMENT I TRY TO PRACTICE IT, I FALL IN LOVE. TRUE LOVE, REAL LOVE, SERIOUS LOVE and NOTHING BUT THE LOVE. Actually selfish charms are important but all of us fails to appreciate and savor the SWEET NECTOR OF SACRIFICE, OH! SACRIFICE, INDEED SACRIFCE WHICH IS SO IMMENSE A MISSING LINK OF OUR LIVES AND OUR CREATIONS.

Chacha Ghalib is great, so great, ever live his words and his poetry. Chacha you had a painful life, first heart break at the age of 5 and that legacy continued till you died. He had 5 dead children and so many, so many and so many KARZAAZ (debts) hovering over his head. The drunkyard icon of subcontinent lived in misery but so rich were his thoughts actually jewels that came out of him.

PAIN PREVENTS PAIN

"Ahimsa" is power but most peace lovers fail to recognize the faculties of might. The peace needs a laboratory environment that can best be created by the 'violence' chemical around. A perfect peace is unattainable but a true peace can be achieved. Now one needs to distinguish between the perfect peace which is UTOPIA and a real peace which involves the dominance of peace over violence. The might may pains apparently but allows a larger benefit. It is virtually impossible for governance to operate without the 'naked sword' but what might be the limits to which this can be used is a query?
Personally i believe that every government is successful if it closely follows the legal code. Not many poor countries realize the power of 'enforcing laws' which is indeed a tough business. It was rightly said that when the governments worry about the people, people no more worries about themselves. Now i may be talking strangely, absurdly, and contradictory but the underlying principle is clear, all clear and very important. With all respect and due regards to Gandhi ji and his adage of AHIMSA, my love for violence need not to be overlooked. The fear of pain is real pain and every criminal will atleast be psychological deterred before carrying out a crime to some extend this way and will help minimize and neutralize the horrors of their action. I love peace but the pragmatism seeks violence and states need violence to protect the weak bodies like me. PEACE LIVES LONG BY THE CAPSULE OF VIOLENCE.

This is to inform all that the situation in LAHORE has got WORSEN. The riots continues and the LAHORITES has completely lost the civic sense. MULLAH'S continue to exploit and the TENSION in the city dawns with each sunrise. I am sure that the hands behind these events have KHAKI gloves on them. The MULLAH tango is at its BEST when in the arms of MILITARY MISTRESS.
SHAME on all MONKS like me, for being the MUTE WITNESS of this ongoing RAPE.

GONE ARE THE DAYS OF LAMENTATION

The great Tagore once said: My tears are not worthless, they will become jewels of my future.

Honourable Chairperson and my dear friends: Today the agony of past and pains of gone years mar my soul, but i will wail no more. The desire of glorious future has been intensified and no more lusts for comfort will cool off this glowing inferno. The reality bites, this small span of life, the worldly mights and the adversary rigths all goes against. Then so comes the unending toil, giant seirras, seas of trouble and incessant sacrifice. But gone are the days of lamentaion.
Ladies and Gentlemen, its a way in the world. When the tears stop, revolution begins. I stand here neither to knit the image of optimism that defies reality, nor canvass the picture of cribs and pessimism. I merely dare to break the ice. Solutions of all troubles lie within. The legacy of our founders, men of honour and true warriors crisscross vividly. Their lesson is all clear: Destiny only manifests itself by talligating our own moves.
My friends! Gone are the days of lamentation when we were merely parasites on our own resources, when we quell each other in the name of our religion and cults and so ferociously we disgraced ourselves by our ill actions. Its all past that we all dwelled in past and ignorance. No more are the days for frozen fat bodies and no more is the time to stop and cry, if at all we are to exist. Our complains, troubles and problems are all obselete. Nepotism, corruption, sectarianism, intolerance and political instability are the old venoms. If the practical world unmatches the theoretical reasoning then it is purely our misery.
Honourable Chairperson! If the days of lamentaion are over then so has arrived the moment of truth. This instant in history will soon be gone. All of us did blunders, sins and shameful acts. Lets buy them all and dare to admit our mistakes. Let us all become functioning models and examples rather than loud sound boxes whose voice dismantles permanently. The battlefronts and warzones is set amidst us. Fuel the future by work, hardwork, true work, pure work, serious work and nothing but the work. Stand by the truth, shape your own principles tolerantly and if some of us are men of honor then nature knows how to assist. Our hollow guts has embarrassed us previously but now only the icons of resistence will ensure justice. Oh justice! so immense a missing link of our lives and our creations.
" No more laments, no more cries
no more wails, no more fails,
Gone are the days,
past is the case,
just ponder the new ways,
Ponder the new ways,
ponder the new ways. " I thank you all.

I said all this at F.C College Declamation Contest and lost.................but! i won the hearts.........

Jab Lahore 'JAL' raha tha.........(WHEN LAHORE WAS ON FIRE)

Yesterday, the Indo-Pak cricket match at Qaddafi Stadium Lahore made me so proud. Pakistan lost but there was a serene sense. At Rahat Mart, for the first time in my life i could see so many foreigners (Indians, Americans, British and Thai). Their presence made me so proud that finally this country may be safe. But! Today, the followers of 'Islam' in their 'love' for 'Prophet' spoilled the show and in a matter of 200 minutes they turned the 'Thandi Sadak' Mall Road into a Road to hell. They were their not only to protest. Following is the list of barbaric acts my fellow townmen have perpetarted.
1) Burning KFC
2) Putting McDonald's on fire
3) Storming Punjab Assembly and torching it
4) Breaking atleast two dozen cars
5) Firing relentlessly in air
6) Torching more than 50 motorbikes
7) Looting the best shops on Mall Road
8) Damaging severly the public property
9) Storming a bank
10) Attempt to put Fuel station on fire.
11) Breaking glasses of Hotels

MULLAH's SHAME ON YOU. Today's event has so ferociously extended my hatred for religious men. I hate them from the bottom of my heart. I will not listen even to the best things that comes out of them. I will do opposite to whatever they say. They are touts, pimps, callow men and a mar on the face of my RELIGION. A mullah is an EVIL, SLAVE OF United States, SELLS HIS SOUL FOR A PENNY, INTOLERANT, KILLER, SNAKE, one who sheds CROCODILE TEAR, LOOTER, CHARACTERLESS and man of VIOLENCE who only understands VIOLENCE.
SHAME ON YOU LAHORE, SHAME ON YOU FOR ALL WHAT YOU DID TODAY? For all other civilians involved in looting business, they were men of hollow characters, assuring us that atleast our 5 upcoming generations will remain handicap too. I am liberally pessimistic. The civic sense reached its abyss today and Valentine was turned into a holocaust

I reiterate my love for Prophet(PBUH)

Ba Khuda Deewana basho, Ba Muhammad(Pbuh) Hoshiar
Say your worse say about God like lunatics, but about Mohammad BEWARE.

Answering Effort

My personal tenet about the portrays/pictures/images of Holy Prophet is different from the great chunk of Muslim body. I believe that the holy images of sacred Muslim figures already exist. In fact it is believed that at least one picture of Prophet Mohammad (PBUH) perhaps in Turkish museum (not confirm) is actually TRUE. The conventional catholic format Muslims, most Shias limitedly allow so, although not greater part of Muslims, traditionalists and Sunnis do not believe such way. My point is that the pictures of Hazrat Ali (as), Hazrat Imam Hassan (as), Hazrat Imam Hussein (as) and many other Shiite Imams along with picture of Hazrat Omer and Hazrat Usman can be found. Some though may be difficult to search but others are so easily available. The purpose of these pictures is simply REVERENCE as those of Jesus Christ, Holy Mary, and Buddha etc. However most Muslims believe that existence of these pictures will diffuse the notion of Perfect Omni potency of God because the Prophet’s respect is so immense that merely His image will make Muslims astray. It is insufficient argument, as although many Muslims may get astray, most will simply abhor it because of no precedents. I may be for the images but all other Muslims will not accept. I in each case respect them all.
Another important reason of non-acceptance of Prophet’s image may be that Muslims cannot imagine the Prophet pictorially and the fears (whether rational or irrational) of accuracy errors may derail the basics of their faith. I personally believe that Characterizing Prophet in movies/films is out of question simply because of His unmatched Character. What doesn’t get into me is that if the most celebrated mournful event of Karbala can be imagined in pictorial manner with images of all major personalities, it lefts little not to allow Prophet’s image. For me, the only major concern for Muslims is that it will insecure their faith and will sabotage the purity of their original belief system. I can readily anticipate that Muslims will never allow Prophet’s image to become part of their faith.
After the emotional part, lets analyse seriously.
I will try to answer the following questions in the days to come. The answers will be constructed subjectively, objectively and importantly perspectively. They may be brief, insufficient and inaccurate but certainly not to answer them cannot be afforded anymore.

1) Whether portrays/pictures/images of Holy Prophet (PBUH) is justified?
2) What is wrong with these Danish Pictures?
3) Why Muslims so strongly reacted to this issue?
4) Are there any boundaries to freedom of press?
5) Why Muhammad should be revered and not to be targeted?

Liberally CONSERVATIVE for the sake of my LOVE

“It hurts, it kills, I am infuriated, I am mad and I am fire up to the neck. Danish newspaper degraded my Ideal, my Love, and the only Forever Person who is Dearest of all to me. They seek freedom by humiliating the Man who is beloved to me more than my parents, my family, my friends, my children and this world. They want to celebrate freedom by portraying Him obnoxiously. In law each can claim damages for seditious, libel and slander reasons. I seek the heaviest penalties of all. If freedom means suffocating others for there believes, for their ideals, and testing them unnecessarily then so be it I seek bondage of this Man only, which they have dared to strip.
Don’t say bad words to the Crown, the King, and the Majesties else you will be persecuted and prosecuted. My Crown, my King has been debased and I seek persecution and prosecution. I am a Human first, then Pakistani and lastly also least a Muslim. But, the love of this Person comes first. His Honour is all to me but these demons demonised him. I hate them for hating my Charm, degrading what actually is revered by me. I am emotional of this outrageous act and the fumes of inferno will never extinguish.”
Just adhere to the following Persian adage:
‘BA KHUDA DEEWANA BASHO, BA MUHAMMAD (PBUH) HOSHIAR’
(Say anything to God like lunatics, but be careful, remain diligence what you say about Muhammad)

I BUY ALL THE ARGUMENTS

An American lady told me that US is an Imperialist force but they promote "progressive imperialism" unlike all the past forms of imperialism which were none but "exploitive imperialism".
I am rattle..........................There is an answer to every question in the world but unfortunately the 'PREBUTTLES' rarely solve our problems. In the interpretation of law we rely on everything which suits are interest and ultimately laws are not followed but just what suits the case. Statutes are stagnant but they are forwarded on the wheels provided by lawyers.
Now, i really believe on life after death. Resurrection will be nothing but just a world where all are questions will finally be answered PROPERLY.
America is Imperial, so was Great Britain but US is 'progressive imperialist'............Okay!

Never before i have felt the agony of "economic distress". I really appreciate those masses who despite of need and exigency strictly adhere to their "principles" and avoid the 'Forbidden' path. Candidly i feel like selling myself, mortgaging my faith and above all trade my values for 'small' amount of WEALTH. I sympathize those who take the wrong path. LES MISERA`BLE, Jean Vaul Jeans will take the bread and run.
I thought of law coming first, but economics beats all. The empty stomach thinks of none but the food. I have done open 'SINS' with staunch witnessess around but those were never of the real bad kind.
LAWS WILL BE FORGOTTEN, RELIGION is not for STARVING, KEN, keep it for the fed soul, VALUES are charms of the book, ECONOMICS wins the BATTLE. ECONOMICS IS god, if you think otherwise ask men without WEALTH. Economics is a science of wealth, laws will prosper ONLY when i will be fed..............I am in a DIRE need of money........Dont offer or sympathise................ JUST BELIEVE ME

The following is the favourite verse of President General Pervez Musharraf.

"Mera azam itna buland hai kay paraye sholon ka khauf nahin
mujhay dar atishay gul say hai kay kaheen chaman ko jala na day" *

I fear the heat of flower that it may not burn my garden)*

When you have nothing to say, the best thing is to keep your mouth shut.

Prophet's Son in Law and brother ALI rightly said:

Ken is indirectly proportional to speech (i.e As knowledge increases, speech decreases)

Subjectivity, Objectivity and now Perspectivity

To stick to the code is the most difficult thing in the world. It is not the goodness or the badness of the law that matters but adherence to it. Societies have prosper by mere adherence to the rules that were so disgusting in every sense. The best society has good laws and good adherence (obviously with an inbuilt mechanism of legal evolution), a just society still has bad laws but good adherence and this allows a system to move forward, but a bad and malignated society actually have some good laws but NO adherence, thus text book evolution will speedily take place but a parallel setup of practical laws will create a huge gulf inbetween. And obviously there still can be a society with bad laws and virtually no adherence, then it would still operate not because of its distance from the 'bad laws' but from the creation of another web of laws that will sprout from practice. So what to do and where to stand off...........No individual can decide but a society.. If the best way to depict the decision of a society is through "democracy" then there still is another long array of queries. For a moment the most vital thing is to have some sort of rules and at an individual level practice the fact that whether one would like to adhere to them or practice them without illgermane propositions corrupting its source in the name of evolution but actually an utter neglection.......
Believe it or not: The system of the world ULTIMATELY operates on MERIT...............

Lamenting the demise

Just received a forwarded message that a friend has died. It is must to pay him the due tribute.

OBITUARY

Today we mourn the passing of a beloved old friend, Mr. Common Sense. Mr. Sense had been with us for many years. No one knows for sure how old he was since his birth records were long ago lost in bueraucratic red tape.
He will be remembered as having cultivated such value lessons as knowing when to come in out of the rain, why the early bird gets the worm and that life isn't always fair. Common Sense lived by simple, sound financial policies (don't spend more than you earn) and reliable parenting strategies (adults, not kids, are in charge).
His health began to rapidly deteriorate when well intentioned but overbearing regulations were set in place - reports of a six-year old boy charged with sexual harassment for kissing a classmate; teens suspended from school for using mouthwash after lunch; and a teacher fired for reprimanding an unruly student, only worsened his condition.
Mr. Sense declined even further when schools were required to get parental consent to administer aspirin to a student, but, could not inform the parents when a student became pregnant and wanted to have an abortion.
Finally, Common Sense lost the will to live as the Ten Commandments became contraband; churches became businesses; and criminals received better treatment than their victims.
Common Sense finally gave up the ghost after a woman failed to realize that a steaming cup of coffee was hot, she spilled a bit in her lap, and was awarded a huge financial settlement.
Common Sense was preceded in death by his parents, Truth and Trust; his wife, Discretion; his dauughter, Responsibility; and his son, Reason. He is survived by two stepbrothers, My Rights and I'm a Whiner.
Not many attended his funeral because so few realized he was gone. If you still remember him, pass this on. If not, join the majority and do nothing.

Peace and Love!

Its a newyear and so far there is virtually nothing new about it...................................
